HOLY CROSS NEW APPLICATION IN CONTRAVENTION OF ORIGINAL PLANNING PERMISSION

In 2010, Chiltern District Council agreed outline planning permission for 196 dwellings and a 64 bed residential elderly care home to be built on the Holy Cross site in the heart of our village. It was considered that a care home is a community facility and would compensate for the loss of the Holy Cross school, which had previously operated on the site. SENSE and the Parish Council vehemently objected to the change of land use, but lost a long legal battle to overturn the decision made by CDC.
A planning application has recently been submitted by McCarthy and Stone to build a 38 apartment Assisted Living development within the Holy Cross site, in place of the care home previously agreed. The application claims that the proposed development is in line with the original planning use status (a residential care home, hospital, nursing home, boarding school, residential college or training centre) however, we believe this is a misrepresentation.

The development by McCarthy and Stone does not in our view constitute a community facility. The apartments are to be built for private sale and any care needs will have to be purchased from an outside agency by separate agreement. Similar McCarthy and Stone properties in Ickenham are currently being sold for between £424,950 and £674,950 and in addition to the purchase price, residents are required to fund a hefty annual service charge.
Whilst the SENSE committee have no objection to this type of development, in fact we positively endorsed the Audley development on the NSE site which offers similar accommodation. We do however strongly oppose the change of land use proposed by McCarthy and Stone. Chalfont St Peter lost a valuable community resource when The Holy Cross School closed and if the current application is granted, we will have lost the comparable community facility due to replace it.
On this basis, the SENSE committee intend to lodge an objection to planning application CH/2016/1716/FA as it is in breach of the outline planning consent. Whilst we object strongly, a condition of acceptance could be for the applicant or the land owner, Persimmon Homes, to provide an alternative comparable community facility, or the equivalent financial compensation to allow the District Council to provide one elsewhere in the village. The village community centre in Mill Meadow is in a poor state of repair and needs to be rebuilt. We believe a substantial contribution towards its replacement would constitute an acceptable level of compensation.
We urge all residents to follow our lead and submit an objection to planning application CH/2016/1716/FA in line with the points raised above.
Our rural landscape is coming under sustained pressure as central government and developers are forcing us to accept more and more development. And now it seems they want our green belt too!
The poor quality of design and the density of these schemes are generally led by financial gain. Our cash strapped District Council are not minded to preserve heritage or push for aesthetic standards and sympathetic styling within these applications. Clearly we cannot expect to receive sensitive schemes from these development corporations – we must fight for it or we stand a very real risk of losing the amenity and essence of what once made our village special.
SENSE4CSP is an action group for Chalfont St Peter formed to fight for appropriate development in Chalfont St Peter. It is a non profit making organisation run by volunteers and we rely entirely on donations and the hard work of a few individuals to continue our work.
Working together with our Parish Council and our residents we have made a stand to fight insensitive planning applications and lack of representation from our District Council. We have had a few successes and some failures, but the fight continues.

Holy cross legal action
Our lengthy battle to save the Holy Cross site from inappropriate development failed. We continue to maintain pressure on Persimmon and CDC to ensure that what is built stays within the agreed planning permission.
